By using or accessing our website and/or placing any order(s), you agree to be legally bound by these terms and conditions. If you do not wish to be bound by these terms and conditions then you may not use or access our website to place orders.

These terms relate to sales over the Internet and to purchases made from our representatives at your premises or elsewhere.

This website is designed for your convenience and if you have any comments or problems and any questions regarding this site and/or products and services featured on the site, please click here. If you have experienced technical problems while using this site please click here.

The contract made by you on-line with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.

You shall not be able to proceed with your purchases until you have read and agreed to these terms and conditions.

1. Product Specifications

1.1 We have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales.

1.2 Products supplied may differ as a consequence from those on display or advertised. Unless agreed with you, the products supplied will be of equivalent value, functionality and appearance.

1.3 We endeavour to display as accurately as possible the colours of our products that appear on the website. However we cannot guarantee the complete accuracy of the pictures or photographs that are shown.

2. Measurements

2.1 We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you.

2.2 All dimensions specified by us are approximate.

3. Prices

3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.

3.2 Goods are delivered on weekdays directly to your home address if you live within the UK mainland, however a delivery charge may apply which will depend on the value of the purchase. You will be notified of any delivery charge before you complete your purchase. For weekend delivery, if available, a surcharge may apply. For delivery to the Channel Islands, The Isle of Man, the Scottish Islands or the Republic of Ireland additional delivery charges may also apply. You will be advised of these additional delivery charges if you telephone our sales number on 01438 751233 before you complete your purchase.

3.3 The prices offered on the website are for on-line purchases and are based upon the information given by you in the DCF (data capture form). Assuming all information provided is accurate and complete then the estimate provided will be complete to +/- 10% and form the basis of the contact between you and The Stone Carpet Company.

4. Payment

4.1 You must pay by credit, charge, debit card or cheque at the time of order. The price of any product is the price advised to you by estimate at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit charge or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.

4.2 Payment will be taken as follows at the time of your order.

4.3 10% non refundable deposit based upon estimate at date of order. A Stone Carpet Person will then arrange to visit, discuss and survey your installation to ensure a quotation can be confirmed and that all circumstances for a successful installation are/will be present. This non refundable deposit commences your contractual arrangement with The Stone Carpet Company although you are under no obligation to proceed.

4.4 75% to process order and secure installation date.

4.5 15% balance upon satisfactory installation payable upon receipt of final balance letter from The Stone Carpet Company.

4.6 The contract shall not have been concluded until we have received your valid credit card charge or debit card payment details or your cheque and we have accepted your on-line order and sent you confirmation by return e-mail to the address you have given us during the registration procedure and on ordering.

4.7 We are entitled to refuse any order placed by you.

5. Delivery

5.1 We are able to deliver online orders to you if you have a permanent address on the UK mainland.

5.2 We will endeavour to fulfil your order by the date set out in the correspondence/advice by surveyor, by which we confirmed your order. Where this communication did not contain such a date we shall endeavour to fulfil your order within five (5) days (or a bit later) the date by which you requested.

5.3 For all orders - any changes made to the content of your order may have an impact on your delivery date. We may therefore be unable to deliver your goods on your confirmed delivery date should changes occur and if so, a new delivery date will be given.

5.4 You are responsible for providing a safe means of access from the public highway to the place of delivery. If our delivery staff consider that access is unsafe then we will not deliver the goods until safe access is provided.

5.5 If you are unable, for whatever reason to take delivery of your goods on the confirmed delivery date or we are unable to deliver the goods due to there being no safe means of access to the place of delivery we shall be entitled to cancel your order and refund your refundable payments less an administration fee of 20% of the order value (up to a maximum of £500 including VAT). If the delivery has to be rescheduled then an additional fee of £100 will be added.

5.6 If we accidentally damage goods in the course if delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.

5.7 Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of The Stone Carpet Company or any reasonable rescheduling of delivery.

6. Installation

Once you're completely happy with your product sample and estimated price, one of our surveyors will call to arrange a site visit so that a pre-installation survey can be made and access arrangements discussed. This is a chance to double-check all the measurements and to ensure that your order includes everything that's needed to complete the job. At this stage, your surveyor will also be happy to quote for any additional works that may be required. All our surveyors and installers are professionals with years of experience and each has been personally vetted by us.

Relax in the knowledge that all work carried out by our approved installers is covered by a 10 year guarantee. We will also separately guarantee any supplementary work carried out by the team.

All products supplied by the Stone Carpet Company are installed by its own skilled and experienced operators/applicators, normally a minimum team of 3 persons.

Delivery of plant and materials will be agreed/arranged in advance following confirmation from your stone carpet person. Confirmation will occur by telephone to ensure that materials and plant are in place and conditions are correct for a successful installation in advance of the installation proceeding.

It is the clients responsibility to ensure that all areas are cleared and accessible by / for our applicators so that works can commence upon arrival.

No access to the areas being placed will be possible during or immediately after installation.

The Stone Carpet Company accept no responsibility for damage/imperfections caused to the flooring as a result of clients accessing the areas too soon/before recommended curing periods.

No responsibility can be accepted for the staining/spoiling of interface areas to the areas being laid although all efforts will be made to avoid any damage.

Some odour may be detected during and after installation due to the presence of ammonia in certain of the products.

The continual presence of a householder or representative is required throughout the installation.

Upon completion of works a signed satisfaction note is required to be signed by the client. In the event that the client is unhappy with the installation and is unwilling to sign the satisfaction note a call must be placed to the Stone Carpet Company explaining the reasons for dissatisfaction prior to the departure of the installation team.

7. Returns, Refunds and your Right to Cancel

7.1 You have the statutory right to cancel any products you have purchased within seven (7) working days of order for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including email) within those seven (7) working days. You will then be entitled to a refund from us, which will be paid within thirty (30) days of your notice of Cancellation.

7.2 After this 7 day period has expired you may in certain circumstances still cancel your order and return the products you have purchased but we will retain an administration fee of 20% of the total order value (up to a maximum of £500 including VAT)

7.3 Subject to your statutory rights, products made or blended specifically for you, may not be cancelled nor will we provide any refund, unless they are defective or have been accidentally damaged by us in the course of production.

7.4 If we deliver incorrect or damaged goods, or in the event that you discover any defect in the goods for which you require compensation or other remedy, you must report the defect as soon as possible. After identifying the defect and advising the Stone Carpet Company by phone or email so that a technical Stone carpet person can arrange to inspect.

7.5 We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.

8. Guarantees and Claims under Guarantee

8.1 The provisions of this clause 8 and clause 9 below, apply in addition to your statutory consumer rights in relation to faulty or misdescribed products. These rights are not affected by the guarantee.

8.3 We guarantee all products against faulty workmanship and/or faulty materials for a minimum period of 10 years from the actual date of installation.

8.4 These guarantee do cover fair wear and tear but do not cover neglect; abuse or misuse of your goods; loss or damage due to fire, smoke, water, lightening, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party.

8.6 We will arrange to repair or replace the defective or incorrect item free of charge. Should a product no longer be available, it will be replaced with an entirely new area that most closely matches it.

8.7 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered/installed materials and above the value of the goods themselves. This does not affect your statutory rights.

9. Site Content and Disclaimers

9.1 Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.

9.2 To the maximum extent permissible by law, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon the information contained on this website.

9.3 Any material downloaded or otherwise obtained through the use of this website is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of date that results from the download of any such material.
